George Bone sworn and testifies. Jerry Latter brought me the barrels of a gun to put on a stock. He said it was loaded, but one tube was stopped up. I was working with it with musle [sic] turned into the fire my wife said don't point it toward me it might be loaded. I told her that he said it was not loaded. I turned it to the door and bursted the caps on it with a hammer on the tube that stoped up. I laid it on the table and picked powder in the tube and put on another cap and struck it with the hammer the gun went off one of the boys run to the winder and said Uncle George you have shot Ben... Ben was lying on the ground in the kitchen dead. The kitchen is about ten steps from the house my children was in the kitchen this boy. I had no idea the gun was loaded. I had worked at it before in my house.
