Hanibal Keller Sworn Says that he lives on Dr Owens place in Farfield County and that his little Brother in law Clarenc Rodgers came to his house Sunday morning the 20th July 1882 in Company with his mother and that as soon as he got to his house he lay down on the bed some time after that about three or four hours he witness was lying on the floor & heard deceased making a strange noise in getting his breath witness went to the bed found him lying on his side drawing long breaths. Witness asked him how he felt deceased did not say any thing witness then lay down on the floor again in a short time he went back to the bed, where the Clarance was lying as he was still drawing his breath hard found him in the same positition witness then went to his brother Franks house a short distance off to let them know about Clarence. Saw Pats Suber & told her about Clarence, the witness then went to catch his mule, caught it & came back to the house and went to the bed found him dead & hollowed back to Patsy that he wsa dead. Witness went on after the deceased mother at the church. Never heard any threats against deceased life. Witness says the deceased was kicked on the head by a mule about four years ago & that his skull was broke. Never heard him complain any that morning.
