Mr. J. C. Hinson, witness, duly sworn, testified as follows: . . . It was almost 6 o'clock. As I was coming up to the top of Deep Creek Hill, I saw a ruck in front of my car. I was driving between 30 and 35 M.P.H. The man came from behind the truck and walked in front of the car. Mt car went about 50 feet after I hit him. I tried to stop. I wasn't drinking . . . When I saw Mr. Tucker, I tried to miss him but I didn't have room. I didn't have time to do anything
