W. B. Toney -- Sworn -- . . . Billie was my son 15 yrs old. Hack Wallace and myself were only ones presend at time of shooting. Me & Wallace setting back to Billie head pistol fire looked around and he was falling. He got pistol out of cyar box I guess I didn't see him get it. He shot one time. Jack Wallace and I were drinking wine & Whiskey. Jack left after shooting. We didn't touch body at all. . . I don't remember gun was cached I don't know where I cached gun or not. .. . Billie was drinking whiskey whit us we hadn't any trouble at all. I didn't fire pistol at all after Bill killed himself. I got gun from last Thurs. I shot gun at Branch. I unbridled on Back porch. And threw shell out of back & about sweep often shell was on back porch yesterday. Jack and I hadn't been in there long. He has been to town. I have never heard Bill threaten to commit suicide. . .
Eunice Laney . . . I don't remember Bill taking a drink about 11 o'clock yesterday. I told Bill on way home that he moving after xmas. He said before he went Back to N.C. and went to school that he would kill himself. I thought he was kidding. I heard him say that before. I was asleep when gun fired. Father was just behind Jack Wallace & they work me up. Father looked a little drunk & scared. . .
