Testimony taken before a Jury of Inquest held on the 17th of January 1816 over the body of Angus McQueen.

David Shrock being sworn says that he went to the house of John Kelly where the dead body was found this morning. Wit[ness] went in company with Mr. Cantey between six and seven o'clock on being told by a small negro girl of Mr. Kelly's that her mistress said she wanted Mr. Cantey to go down that Mr. K. had killed a man. Wit. Says that no person except Kelly and family were in the house while he was present. Mrs. Kelly reproached her husband as often as twice for killing the man and asked him why he did not bring him out and let Wit. & Mr. Cantey see him. Kelly said he hoped the man was not dead.

Mrs. Cantey being sworn says that a small neg. girl of Mr. K. came to her house a little after night and said her mistress wished wit. to go down that Mr. K. had killed a man. She went and saw none in the house but Kelly and family. Mrs. Kelly was much distressed and in tears. Mr. Kelly was quite intoxicated. Wit. thinks Kelly said he had not killed the man. The floor was covered with a carpet on which she discovered something like puking. Mrs. Kelly and children staid with wit. the last night and during the night.... Kelly was quite drunk and continued drinking.

Nancy McDeveright[?] Being sworn says by H. McFall her sworn interpreter she went to Mr. Kelly's a little while after night with a view of staying there all night. She saw Mrs. K. and her child were crying and hallowing that she saw the carpet and that there was at least a hand full of blood upon it. She on seeing the blood suspected what was done and went away. The wit. says Kelly was drunk and that the dec'd was also drunk. Wit. went to Kelly's at first with the deceased. She soon afterward went out and returned while Mr. Kelly and her child were crying. Wit. [?] know that any quarreling took place between Kelly and the deceased.

Hugh McClean sworn says that he lives with Kelly. The dec'd came to Kelly's about one o'clock in the evening.... Kelly and dec'd together with two other men were drinking in Kelly's house until night when the two strangers went away. Wit. saw the dec'd lying on the carpet and blood flowing from his nose. Wit. dragged him off the carpet into an adjoining room. Wit. did this of his own accord. Wit. saw him lying in the same posture that he had left him about nine o'clock. Kelly insisted [that he] stay for dinner. Wit. and Mr. D slept at Mr. Doby's[?] all night. Next morning they inquired of Mr. Kelly how Mr. McQueen was. Kelly answered that he was still asleep and had not got up. Kelly after a while went into the room to wake the dec'd and seemed to wit. to be greatly surprised at finding him dead. During the evening Kelly McDermit and the deceased drank one gallon of spirits. The dec'd was very much intoxicated and fell down four times during which time he vomited upon the carpet. The dec'd seemed to fall very hard every time. Wit. saw no bleeding at the nose & in one of his falls the dec'd fell [?] a table. Wit. does not however know that any bruise or wound was inflicted by the table. He fell with his left side against the table. Kelly told McD & wit. that if they would leave the dec'd in his house he would take care of him.

Dr. Langley sworn says he saw no sufficient signs of external violence to produce death. The death of McQ may have proceeded from the combined effects of cold and intoxication. The skull not in the least injured nor the brain effected.
